In New York, defense attorneys deliver closing remarks first, followed by prosecutors. Lawyers are not supposed to explain the law in their closing arguments, something Merchant reiterated Tuesday. Instead, lawyers are supposed to present their arguments on what they think the facts and evidence in the case show. Then judges explain the law and juries are supposed to ultimately decide.
